X-Plane devs sued by Uniloc for patent infringement:

Uniloc are at it again. They went after Mojang a couple of months back for the infringement of patent 6,857,067 which covers mobile applications that “require communication with a server to perform a license check to prevent the unauthorized use of said application.” They’ve launched a new lawsuit against X-plane developer, Laminar Research, for violation of the same patent.
“I am told that it will cost me about $1,500,000 (one and a half MILLION dollars) to defend this suit,” writes X-Plane creator Austin Meyer on the X-Plane site. “This is more money than I have made selling Android Apps in the first place. Under theses conditions, does it make sense for me to be in business?”
Uniloc claim to be “in the business of finding big ideas” according to their site, and a glance at their management strata suggests that they’ve found many of them inside the head of one Outside General Counsel, Jim Etheridge, who spent 13 years at EFI taking “worldwide responsibility” for legal matters “including intellectual property and all aspects of litigation strategy.”
His five years with a Californian IP firm spent “drafting and prosecuting patent applications in the US Patent and Trademark Office” is certainly proving useful, and seems to dovetail nicely with the company’s mission to “look at many ideas. Pick an outstanding one. Patent it. Commercialize it. Reap the rewards.”
Uniloc reaped an undisclosed figure from Microsoft in a landmark settlement earlier this year (more on Bloomberg). That case took eight years to settle. Bloomberg mention that they’ve sued Symantec and Adobe over the same patent.
“Speaking for Laminar Research, we used only the technology that was provided to us by Google for copy protection in our Android App ‘X-Plane’” says Meyer. “We used exactly the copy protection Google gave us! And, of course, this is what Google provides to EVERYONE ELSE THAT IS MAKING A GAME FOR ANDROID”
Laminar are co-operating with other companies affected by similar suits. “I have begun a plan to share defense fees amongst the other companies being sued, probably increasing the overall cost of the lawsuit further, but making my defense-cost share only a part of that total,” he says.
It’ll probably take years for this one to work itself out, which means there’s plenty of time to listen to This American Life’s When Patents Attack! episode, which offers some interesting insights into the strange world of patents.

Two Bohemia Interactive employees were arrested by Greek authorities for espionage last week after recording footage of military bases in Limnos. BI have sent over a statement saying that reports claiming that they’d entered military installations and taken footage to support development of Arma 3 are “completely false and without substance.”
“These employees – our friends, Ivan Buchta and Martin Pezlar – visited the island as tourists. Their holiday was a product of their interest in the island, triggered by their work on Arma 3 over the past two years of development,” they say.
“They took photographs and videos in public areas, as countless tourists arriving to enjoy the beauty and hospitality of Greece may well do. These included a short video as they drove through the main road passing around the international airport, where in one short part of the video off in the distance some hangars and other buildings of the complex can be seen. It’s very likely that many tourists may have pictures similar to those taken by Ivan and Martin in their own family albums, without being aware that they put themselves or their families at risk.”
The description conflicts with the account that Greek police offered to Czech officials, according to comments from Czech foreign ministry spokesman, Vit Kolar, picked up by The Escapist. “We have a statement from the Greek police saying they were taking pictures and video footage of military facilities on the island on which they were detained, and that they entered the military facilities despite a warning.”
BI are using Limnos as inspiration for the fictional island we’ll be fighting for in Arma 3. “The in-game Limnos is close to completion, and it’s far from an identical replication of the real place,” they explain. “It was heavily modified to fit the game’s backstory, a purely fictional 2035 setting. It was rescaled to only 75% of the real island, and it does not attempt to display any real world military installations situated on the island of Lemnos.”
They stress that no military objects were photographed as source material for Arma 3 units or locations. Buchta and Pezlar are currently being held in Mytilene. “The conditions are tough, but the people we meet treat us fairly and correctly,” they say in a statement. “It is all a completely absurd misunderstanding that will certainly be quickly explained. We mainly think of you, our families; you have to stay calm and not to worry about us. We hope we will meet soon.”

Blade & Soul slashing western markets:
MMORPG to be set in Asian-inspired fantasy world with martial arts; no release date set.
NCsoft has announced that its free-to-play MMORPG Blade & Soul will be seeing a North American and European release.

The game is set in an Asian fantasy setting filled with Asian martial arts that players will use to initiate combat with. Gamers can choose between four races (gon, jin, kun and lyn) and six classes (assassin, blademaster, destroyer, force master, kung fu master, summoner).

The title is developed by NCsoft internal studio Team Bloodlust and was released in Korea on June 30, 2012. The game has surpassed Diablo III as the most talked-about game during its open beta session in the country.

No official release date has been announced as of yet.

Aussie gamers won’t be stumped for choice this week, with a variety of games hitting local shores. From platformers to soccer, and shooters to racing titles, there's something to suit almost everyone's taste!



Gamers who are ready to return to Pandora will be interested in the imminent release of Borderlands 2. The title is a sequel to developer Gearbox Software’s well-received loot-based co-op shooter Borderlands. Set five years after the events of the first game, Borderlands 2 will introduce new character classes, enemies, weapons, equipment, skills, and sections of Pandora to explore.

A recent game guide writer's play-through of the sequel reportedly took 58 hours. Borderlands 2 hits shelves on September 20 for the PS3, 360, and PC.

The Pro Evolution Soccer franchise takes to the field this week for its 2013 season. Developer Konami has promised improvements for the game in the areas of audio and social networking. The game's audio effects "are being tied closer to the on-field action", the company said. It also confirmed that it is planning an extension to the myPES application for Facebook, which will "extend the connectivity and communication between Facebook-using PES fans".

Hankering for something on handheld instead? Platformer title LittleBigPlanet PS Vita will be out this week. The game contains tools from previous versions of LittleBigPlanet, and has been tweaked for use on the PlayStation Vita.
